Tenancy at will
This document contains a draft tenancy at will.
A tenancy at will may be considered as an appropriate vehicle for the occupation of business premises as a temporary expediency. The benefit of a tenancy at will (if genuine) is that it does not attract security of tenure under the Landlord and Tenant Act 1954. However, nor does a genuine licence to occupy premises (which, admittedly, is difficult to achieve in practice) or, subject to exceptions, a short fixed term tenancy not exceeding 6 months. For safety's sake, a short fixed term lease is preferred over a tenancy at will because of the risk of the latter being construed as a periodic tenancy protected by the 1954 Act.
