Transfer of part clauses

This document contains draft clauses to be included in a Land Registry Form TP1 (transfer of part).

The clauses are intended to be inserted in the additional provisions panel of the transfer. They contain easements to be granted to the transferee and to be reserved for the transferor's retained land, positive and restrictive covenants, and common form declarations.

The document contains sample covenants and easements which will need to be adapted or added to to meet the circumstances of the transaction.

As from April 2010, following the commencement of the Perpetuities and Accumulations Act 2009, which limits the operation of the rule against perpetuities in instruments made from commencement of the Act to a limited number of trust cases set out in section 1 of that Act, all references to perpetuity periods have been removed from this precedent.
