The following cases were reported in the November 2003 issue of the CPI Update:

  • Foreign Property ApS v Secretary of State for Health - VAT; option to tax; contract requiring evidence of election to waive exemption;
  • McDonald v Fernandez - Landlord and tenant; service of statutory notices; Mannai test applied;
  • Sheffield & Regional Properties Ltd v Wright - Insolvency; disclaimer; release of a guarantor;
  • Wesleyvale Ltd v Harding Homes - Right of way; extent of an easement;
  • C&J Clark International Ltd v Regina Estates Ltd - Licence to assign; proposed change of use.
