The following cases were reported in the November 2005 issue of the CPI Update:

  • Albany Construction Co. Ltd v Cunningham - Land registration; registering agreed and unilateral notices;
  • Edlington Properties Ltd v JH Fenner & Co. Ltd (High Court) – Using rights of set-off against successors in title;
  • LMS International Limited v Styrene – Nuisance; the rule in Rylands v Fletcher;
  • Davies Attbrook (Chemists) Ltd v Benchmark Group plc - 1954 Act lease renewal; including a landlord’s break option for redevelopment;
  • Ayton Ltd v Popely - Land registration; the abolition of land certificates.
