The following cases were reported in the July 2005 issue of the CPI Update:

  • Crestfort Ltd v Tesco Stores Ltd - Consent to underlet; satisfying pre-conditions;
  • Abbey National plc v Commissioners for Customs & Excise – VAT on virtual assignments; assignment of rental streams;
  • Keydon Estates Ltd v Eversheds LLP - Professional negligence; underlease taking effect as an assignment of a lease;
  • Wessex Reserve Forces & Cadets Association v White - 1954 Act; redevelopment; section 30(1)(f) LTA 1954;
  • Fairgate International Ltd v Citibank International plc - Yielding up obligations on lease termination;
  • Savva v Jaikaran - Sale of land; assignment of the benefit of a contract;
  • Freeguard v Royal Bank of Scotland – Duties of a mortgagee when exercising a power of sale.
